PUBLIC HEARING:

ZBA2018-7 Application for Auto Use Location at 25 Mihaliak Road (Map 46 Lot 20 Zone R80) Owner: Christopher Barr Applicant: Showcase Service Center LLC (Received December 13, 2018 Public Hearing January 10, 2019 Decision within 65 days after close of P.H.)

Mark Masinda called the Public Hearing to order.

The applicant Christopher Barr from Showcase Service Center said that he had recently purchased 25 Mihaliak Road and is seeking approval for the DMV application for auto repair and towing.

He said that the property would continue with the same use, a service station doing auto repair and towing.

John Rup asked the applicant what the primary business was going to be. C. Barr stated the business is towing and auto repair, they have had a contract with AAA for 17 years.

J. Rup asked how many trucks he planned on having. C. Barr stated the state required at least 2 trucks minimum, he would have between 4 and 6 trucks. He said that Showcase Service Center also has a location in Southington, CT.

M. Masinda asked how many vehicles will be on site. C. Barr stated he could not be sure but that the state mandates that the cars be kept in a secure fenced lot. The vehicles will be located in the back of the property.

J. Rup asked what other approvals were needed. C. Barr stated that the DMV would be coming out to inspect the property and look over the paper work.

Michael D’Amato zoning agent stated the location is already an existing use. Under the current State Statute the Certificate of Location comes from ZBA. The DMV will be looking for the ZBA approval.

B. Bland said that at the site walk he notice a well in the back of the property back. He asked if they were any requirement for distance from the well. C. Barr said not at the state level, may be at the local level. He said that the property had a clean bill of health when he purchased it. The tanks had been removed and the ground was not contaminated. C. Bar stated that he will try to keep cars away from the well.

J. Rup asked about the site walk. M. Masinda said the site walk was January 3, 2019 he described the property as triangular in shape and over ½ acer. At the back of the property line the grading of the land goes up.

M. Masinda ask if anyone present wanted to speak either for or against the application.

No one had any comments.

M. Masinda closed the Public Hearing.

R. Maloney motioned to approve the Certificate of Location.

Discussion was held on the fencing which is required by the state. They discussed the aesthetic of the building, the location of the well, and the storage of vehicles in front of the building.

W. Bland seconded the motion all voted in favor.

 

Minutes

R. Maloney motioned to approve the minutes of November 8, 2018, with the following correction last paragraph under P.H. J. Prusak not W. Bland spoke and under old business J. Prusak spoke not W. Bland in the fourth paragraph W. Bland seconded the motion.  All voted in favor

 

Richard Mindek from the Economic Development Commission was present to speak to the Board Members.
